On the 18th of this month, the Seoul Central District Court's 63rd Division of Civil Agreement decided to dismiss Ku Hye Sun's damages lawsuit demanding payment of 107 million won to former management office HB Entertainment.
In August 2019, Ku Hye Sun announced the termination of the Exclusive Contract with HB Entertainment, which she was affiliated with, after divorcing her ex-husband Ahn JaeHyeon. Before and after the divorce, he complained that the management office handled the business only from Ahn JaeHyeon's standpoint. As a result, the two parties received an arbitration award from the Korean Commercial Arbitration Board to conclude the case. The terms of the arbitration were that Ku Hye Sun would pay 35 million won to HB Entertainment in exchange for completing the Exclusive Contract signed in June 2019.
Ku Hye Sun filed a lawsuit, claiming that he had paid the amount stipulated in the arbitration terms, but that "apart from the arbitration, the former management office obtained property benefits without any legal problems." In order to restore his own labor to the original state, he has to pay 60 million won for all 12 YouTube performances, 10 million won for editing expenses, and 3 million won for music usage, advertising income of 30 million won, and YouTube revenue of 4 million won.
However, the court dismissed it, stating, "It is not enough to find that the effect of the contract has been extinguished retroactively before its establishment, and there is no evidence to support this."
Ku Hye sun immediately decided to appeal. She said, "I believed in my former spouse (Ahn JaeHyeon), so I was happy to appear on the YouTube channel operated by HB Entertainment, which he belongs to (over 12th), without compensation. She continued, "Many people who were worried about me advised me that it would be best not to respond, but there is a reason for me to appeal. I started with a personal wish that I would never experience anything like me again, and with the intention that I must sound a warning to the tyranny of the production system, such as 'power harassment,' in which payment is not made after the selection process. Wrong habits must be eliminated and corrected, so I would like to correct them through an appeal."
However, HB Entertainment did not remain silent. In response to Ku Hye Sun's appeal, HB Entertainment said, "For several years, we have had to continuously take legal action due to disputes regarding Ku Hye Sun's Exclusive Contract and lawsuits based on repeated false allegations. It is causing serious damage and mental damage to the officers, employees and affiliated artists."
Even so, they said, "Because Ku Hye Sun was an actress with the agency for a short time, we refrained from media reports on the unfair claims from Ku Hye Sun that continued for several years, and responded only legally. Even the ruling is distorted and denied, and since it can no longer be overlooked that it interferes with the business of the company and seriously damages its reputation, all false disclosures and false reports of Ms. Ku Hye Sun are legally enforced. We will proceed with formal procedures."
Ku Hye sun and HB Entertainment's profit dispute is getting bogged down. It seems endlessly far away where the end is.
