Man in his 20s who assaulted female part-time worker for calling her a ”feminist” received three years in prison... Pleads to mental impairment (South Korea)
A man in his 20s who indiscriminately assaulted a short-haired female part-time convenience store clerk was sentenced to prison. The court acknowledged that the man was in a state of mental impairment.
On the 9th, the Jinju branch of the Changwon District Court announced that he was charged with violating the law on the punishment of violent acts (Kyodo News).
The court sentenced Defendant A, a man in his 20s who was tried on charges of assault (violent assault), to three years in prison. It also awarded 2.5 million won (approximately 280,000 yen) in compensation to the owner of the convenience store where the incident occurred, and a fine of 1,000 yen (approximately 1,000 yen) to anyone who tried to stop the assault at the scene.
The court ordered the payment of 10 million won (approximately 1.12 million yen) in medical expenses and compensation to a man in his 50s who was injured.
"The defendant was presumed to have been in a state of mental impairment at the time of the crime, and the results of a psychiatric evaluation concluded that it was highly likely that his ability to assess reality was impaired," and "the circumstances, words, and actions of the defendant, as well as the method used,
"Taking all these points into consideration, we found that the defendant was mentally impaired," he said. "The victim was wearing a hearing aid, and the man in his 50s was in the hospital for a week," he said. "Defendant A was not forgiven by the two.
Although each organization petitioned for severe punishment, the sentence will be decided after taking into consideration the fact that it was a first offense and that he was in a state of mental impairment."
Defendant A is accused of indiscriminately assaulting a female part-time employee in her 20s at a convenience store in Jinju City on November 4 last year.
At the time of the crime, Defendant A reportedly told the victim, "When I see that you have short hair, you are a feminist," and "I am for 'male solidarity,' so feminists should be beaten up."
Defendant A also punched a man in his 50s who tried to stop the assault at the scene, causing fractures in his shoulder and other parts of his body. The man in his 50s was unemployed and struggling to make ends meet, and was even receiving psychological treatment.
After the trial ended, women's groups such as the Women's Party held a press conference in front of the Jinju branch of the Changwon District Court, stating that the court had taken a paternalistic approach to the defendants.
The Jinju Sexual Violence Victim Counseling Center and 225 Solidarity Group said, "The court handed down the sentence after taking into consideration the defendant's mental impairment," and added, "The cause of this crime was mental illness.
The victim said, "It's unfortunate that the sentence of five years was not met and that the word 'hate crime' was omitted. I hope that I will never be able to commit this crime again."
I hope there will never be another victim like her." A man in his 50s who received a plaque of appreciation from the city of Jinju today said, "I was only given a three-year sentence, but I'm glad that he was given the actual sentence.
"I thought about it," he said, expressing his feelings, "I was nervous that I would be given a suspended sentence."
