Detective 3Exclusive (Judge: Kim Do-hyun) sentenced Mr. A, a man in his 60s, who was tried for stalking teenage singer Oh Yu-jin and her family (violating the Stalking Punishment Act) to eight months in prison and 10 months in prison.
He was given a two-year suspended sentence. He was also ordered to take a 40-hour stalking prevention class and to take measures to prevent approaching the victim. Prior to this, Mr. A had filed a lawsuit against Oh Yu-jin's biological parents through an online community.
Furthermore, from May to November of last year, he claimed that Oh Yu-jin was his daughter, called Oh Yu-jin's maternal aunt, demanded to meet her, and even appeared at an event venue.
In response, Oh Yu-jin's management office TOTALSET charged A with violating the law on the punishment of stalking crimes, and the law on the promotion and use of information and communications networks.
The prosecution filed a complaint on suspicion of violating the law on the protection of minors, etc. (false defamation), and at the closing hearing held on the 5th of last month, the prosecution stated that the crime committed by Mr. A against the very young victim was of a high level of crime.
Taking into consideration the above and the mental anguish suffered by the victim and her family, the court sought a one-year prison sentence and an order to complete a stalking treatment program.
In a statement shortly after, Mr. A said, "I ended up in this situation because I heard from acquaintances that I resembled Oh Yu-jin.
"I felt a sense of connection with my family and decided to do something like this," he said, adding, "I didn't mean to surprise my family."
Today, on the day of the sentencing, the court stated, "Mr. A recognized the victim as his daughter without any reasonable grounds and took responsibility for this incident.
"The sentence will be decided based on a combination of factors, including the fact that he requested genetic testing without reflecting on his mistakes, the length of time he wrote the comments, and the fact that the victim has complained of mental distress," the statement said, adding that he would impose a prison sentence and suspend the execution of the sentence.
However, netizens responded to the sentence with comments such as, "Why aren't they sending him to prison when he has no remorse?" and "Why did he stalk his grandchild?"
They have responded dissatisfiedly, saying, "Is this just a suspended sentence?"
