Mr. A, who runs a restaurant in Gimhae, South Gyeongsang Province, was sentenced to 200 hours of community service. From May 15 to 18, 2022, Mr. A cooked shredded eggs, an ingredient in cold noodles, and did not cook the eggs thoroughly.
The cold noodles were stored unsealed. As a result, many people became infected with food poisoning, including Mr. B, who died after eating them. An autopsy revealed that Mr. B's cause of death was septic shock due to acute enteritis.
It was confirmed. A's lawyer said, "B, who died, had an underlying condition. He had been taking gastrointestinal medicine for a long time, and ate the cold noodles in a state where his stomach and intestines were not functioning properly. A's duty of care was violated.
"There is no causal relationship between the cold noodles provided by Mr. A and the death of Mr. B." However, the court did not accept this. The court ruled that the cold noodles provided by Mr. A invaded the entire intestinal tissue of Mr. B.
Inflammation occurred, and Mr. B died of septic shock. The court ruled, "More than 30 people became ill with food poisoning, one of whom died. Mr. A admitted to most of the crimes and expressed deep regret.
"We decided on the sentence after taking into consideration the fact that he was in a difficult position," he said.
