On the 10th of this month, CBX, an artist of "EXO" belonging to INB100, filed a lawsuit against SM Entertainment for unfair treatment.
On behalf of CBX, ONE HUNDRED Chairman Cha Ga Won, INB100 CEO Kim Dong Jun, and lawyer Lee Jae Hak attended the press conference.
They claimed that M Entertainment had not fulfilled its promised 5.5% music distribution fee, and instead demanded 10% of the artists' individual sales.
Hyun and Xiumin renewed their contracts with SM Entertainment in December 2022, and notified them of the termination of their exclusive contract in June last year. At the time, singer MC Mong was accused of tampering (illegally engaging in an illegal relationship before the end of the contract).
This sparked controversy, but since then, EXO's group activities have been carried out under SM Entertainment, while their individual activities have been carried out under CBX's new corporation, and the dispute has been resolved.
However, last month, INB100 was merged with a subsidiary of ONE HUNDRED, which MC Mong had co-invested in, and tampering allegations arose again. Since then, CBX has been questioning the distribution fee rate.
After the press conference, SM Entertainment stated, "We were referring to our intention to help CBX in the dispute with the distributor so that negotiations would go smoothly. Initially, our company was considering other distributors.
In fact, during the process of signing the agreement, CBX asked us to include details regarding the distribution fee rate as a condition of the agreement, but we do not have the authority to decide on it.
Therefore, we explained that it could not be included in the contents of the agreement and deleted the relevant provision, and as a result, the original agreement does not include the relevant clause."
As the dispute between the two sides has flared up once again, SM Entertainment has filed a lawsuit demanding that CBX fulfill its contract, and a full-scale legal battle is expected to ensue.
