Yoo Dae-gyun, the eldest son of the late Yoo Byung-un, chairman of Semo Group, filed a lawsuit claiming that the tax treatment on EMBEZZLEMENT money was unjust, but lost the case in the Supreme Court.
According to the legal profession on the 13th, the Supreme Court's 3rd Division (Chief Judge Noh Jeong-hee) decided to settle the comprehensive income tax instalment filed by Yoo against the head of the Seocho Tax Office on the 17th of last month.
The appeal court for the lawsuit over the cancellation of the levy overturned the lower court's ruling in favor of the plaintiff and remanded the case to the Seoul High Court.
He was arrested on suspicion of receiving 3.5 billion won from Chonghaejin Marine, the shipping company behind the 1999 item, 2 billion won from Da Panda, and 1.3 billion won from Chonghaeji (EMBEZZLEMENT under the Act on Aggravated Punishment of Specific Economic Crimes).
In September 2015, he was sentenced to two years in prison and served his sentence. In September 2017, the Seocho Tax Office recalculated his income to include royalties for the trademark rights paid to him by a Semo Group subsidiary, and filed a tax return on November 11th.
A total of 300 million won in comprehensive income tax (including surcharges) was imposed.
