The so-called "Goo Hara Law," which prevents parents who neglect their child-rearing duties from inheriting their children, has attracted attention after passing through the National Assembly plenary session five years after KARA's Goo Hara passed away.
On the 28th (today), the ruling and opposition parties held a plenary session in the National Assembly and passed the "Koo Hara Law" (a bill to amend the Civil Code). The bill provides that if a person fails to fulfill their obligations to support the deceased or commits crimes such as abuse, the deceased will be exonerated.
In fact, the law includes provisions that restrict the inheritance rights of legal heirs who are not worthy of inheritance, such as in the case of a will of the deceased or a request by joint heirs.
The family court must accept this. Previously, shortly after Hara passed away, her biological mother, who had left home when she was 9 years old and had cut off contact with her, showed up for the first time in 20 years and filed suit against her.
Hara's older brother, Goo Ho-in, said, "I hope that the tragedy that Hara and I suffered when we were abandoned by our mother when we were young will not happen again in our society."
The law was introduced in the 20th and 21st National Assembly, but was passed when the term expired.
It took about five years for the bill to pass the National Assembly. The amendment will come into effect in January 2026.
Retroactive application will also apply if the inheritance begins after the 25th of the month (regardless of the contract date, by stating in the contract that the contract will be applied retroactively to the date of the contract date, such as "this will apply retroactively to the date of the contract date").
On the other hand, the late Hara suddenly passed away on November 24, 2019, at the age of 28.
