”Pool staff saw me naked”... Police officer fined for posting 185 false posts in South Korea
A female police officer in her 40s has been fined for posting a false statement online that "a swimming pool staff member had peeked at female members naked on multiple occasions."
According to the Korean legal community on the 18th, the Supreme Court ruled as above against Defendant A, who is accused of defamation and obstruction of business. The Supreme Court imposed a fine of 3 million won (
The case began in September 2021 when leak repair work was carried out in the changing room of the pool at the sports center attended by Defendant A.
While working on the project, facility manager B accidentally saw A changing clothes. The center should have checked in advance whether there were female members and installed a blindfold.
Despite this, this was the result of neglect. Although B had no intention of doing so, Defendant A felt resentment for this. He filed a complaint against B at the police station, but was found not guilty, so he interviewed B.
- He started posting false information online. He posted false information on cafes, blogs, the Blue House National Petition Board, etc., such as, "B used his job as an excuse to secretly peek at the naked bodies of female members many times."
The posting was published 185 times. In the end, Defendant A was put on trial on charges of defamation against B and obstruction of the Center's business.
The first-instance court sentenced him to a 3 million won fine in August last year. The first-instance court said, "The defendant is a police officer, but he posted false information in B's name and used it for advertising purposes.
"Not only did it damage their reputation, it also disrupted the center's business," he said, adding, "Considering the number of crimes committed, the crimes are not light."
The second trial also made a similar decision. In May of this year, the second trial imposed a fine of 3 million won.
The court ruled that "the defendant, as a police officer, repeatedly posted false information on the Internet despite the decision to clear Mr. B of all charges," and that "the decision of the first instance court was justified."
The Supreme Court also upheld the 3 million won fine, stating that "the original (second instance) ruling did not contain any misunderstanding of legal principles."
