Storm is set to begin a criminal trial in December over the mixing platform he developed.
Roman Storm will face a criminal trial over the cryptocurrency mixing platform he developed after a judge rejected his attempt to have the U.S. government's charges dismissed.
If convicted of all charges, he could face up to 45 years in prison.
In a conference call, Judge Marcine Polk Failla denied Storm's request to dismiss three federal charges brought by the Justice Department, allowing prosecutors to pursue more charges against him.
Storm and co-founder Roman Semenov were indicted in August last year on charges of conspiracy to launder money, conspiracy to violate sanctions, and other charges.
At this stage, Judge Failla said, "I cannot accept the argument that Storm simply wrote the code."
"Dash is not like any other financial services or money transfer company," the judge said in a statement based on the indictment. "The platform was not an altruistic venture."
The ministry alleged that Tornado Cash received about $1 million in funding from a venture capital firm and that the company expected to receive a cut of the proceeds.
Meanwhile, Jake, Chief Legal Officer of cryptocurrency venture Valiant,
"Judge Failla's decision is an attack on the freedom of software developers," Chervinsky wrote on Twitter.
"This case will go down in history as a perversion of law and a sacrifice of justice," he wrote, adding that it "must be blocked on appeal, if necessary."
