“俳優のイメージに悪影響”を訴えたが…スジ(元Miss A)やコン・ユら所属「マネジメントSOOP」、旧afreecaTVに出した訴訟が棄却
Although they complained that it had a negative impact on the image of actors, the lawsuit filed by Management SOOP, which manages Suzy (former Miss A) and Gong Yoo, against the former afreecaTV was dismissed.
Management SOOP, the agency that represents singer and actor Suzy (former Miss A) and actor Gong Yoo, has filed a provisional injunction against the video service afreecaTV to prohibit infringement of trademark rights.
On the 4th, the Seoul Central District Court dismissed a request by Management SOOP Co., Ltd. for a provisional injunction to prohibit infringement of trademark rights, etc. against SOOP Co., Ltd.
Management SOOP's application for a provisional injunction against the former afreecaTV was dismissed, allowing the former afreecaTV to use the SOOP Inc. trademark.
The court said, "There is room to see that the trade names of the creditor and debtor are similar. The creditor produces video content featuring its artists and uploads it to the internet.
"It is difficult to see how the human resources management business and the debtor's live streaming platform operation are closely related to each other."
Prior to this, in June, Management SOOP revealed that it had filed an application for a provisional injunction to prohibit trademark infringement against the former afreecaTV.
At the time, Management SOOP said, "Since our establishment on April 19, 2011, we have been using the trade name 'SOOP Entertainment' and have been operating under the name 'SOOP Inc.'
"We hold the trademark rights to the marks 'OP Entertainment', 'Management SOOP' and 'SOOP'."
At the same time, "Recently, afreecaTV Co., Ltd. changed its name to SOOP Co., Ltd.
Ltd.) and adopted and is using the "SOOP" mark as its CI. This is an act that infringes on our company's trademark and trade name rights."
"If afreecaTV continues to behave in this way, it will damage the reputation and credibility that we have built up, and it will negatively impact the image of our actors," the company said.
This will have a lasting impact on the company and such damage cannot be recovered after the fact," he said in explaining the background to the application for provisional measures.
Management SOOP will take firm action to protect the image of its actors.
However, the court rejected the application for a provisional injunction to prohibit trademark infringement, and the former afreecaTV was able to use the name SOOP Inc.
Meanwhile, Management SOOP has Suzy, Gong Yoo, actors Kong Hyo Jin, Kim Jae Wook, Seo Hyo
Its members include Lee Jin, Lee Choon Hee, Jung Do Yeong, Jung Yumi, Nam Jihyon, Choi Woo-shik, and Nam Ju Hyuk.
