In South Korea, a man in his 50s who invited a man he believed was having an affair with his wife to a motel and assaulted him has been given a suspended sentence.
The Gwangju High Court indicted him on charges of special injury and sentenced him to six months in prison in the first trial.
Defendant A (58 years old), who was given a two-year suspended sentence, received the same sentence as in the first trial. Defendant A shot victim B in the head at a motel in Jeollanam-do in December 2022.
Defendant A, who suspected his wife of having an affair, used her mobile phone to pretend to be his wife and sent messages to victim B saying "I want to see you" along with her address.
Defendant A, who was waiting at the motel, asked Victim B, who entered the room, "Is there anything you're hiding?" and as soon as Victim B answered, "Nothing," Defendant A assaulted her.
The court stated, "The defendant has no previous record of being punished for a similar crime," and "It appears that the crime was committed accidentally when the victim suspected that she was having an affair with the defendant's spouse.
"However, considering the method of the crime, which was to hit the victim with a blunt object, and the parts of the body that were hit, we believe that the defendant's guilt is light.
"This is not acceptable," he said, adding, "The sentence handed down by the original court is appropriate."
