In an appeal hearing for a man in his 20s who was charged with throwing his disabled friend into the sea after losing a game of rock-paper-scissors to death, and who was sentenced to assault resulting in death instead of murder in the first trial, the prosecution decided to give the defendant a heavy sentence.
At the closing hearing of the appeal trial for the murder charge against Defendant A (20) held at the Gwangju High Court on the 7th, the prosecution found the defendant guilty of murder and sought a sentence of 25 years in prison.
However, the prosecution changed the indictment to include assault resulting in death as a preliminary charge in case the defendant was found not guilty of murder.
The prosecution said, "Even if defendant A did not have a definite intention to kill the victim at the time of the incident, he did have a vague intention to do so."
"I want the trial court to revoke the not guilty verdict and sentence the accused to guilty," he said. Defendant A said in his final statement, "The crime I committed will never disappear, but I will live my life with the utmost remorse and with the victim in mind."
Defendant A, along with two teenage accomplices, threw the mentally disabled victim (18) into the sea from a floating pier at the wharf in Mokpo, South Jeolla Province, on February 1 of this year.
He was indicted on suspicion of causing the death of a victim. Although he was found not guilty of murder in the first trial, he was found guilty of assault resulting in death and sentenced to four years in prison.
The two teenage accomplices were sent to the juvenile division of the Family Court on charges of aiding and abetting assault.

The court found Defendant A not guilty of murder and instead sentenced him to prison for assault resulting in death. The appeal sentencing hearing for Defendant A will be held on December 19th.
