YULHEE (former LABOUM) has filed a lawsuit for child custody and property division after revealing the private life of her former husband, Choi MIN HWAN of Korean boy band FTISLAND.
Meanwhile, experts have argued that it will not be easy for YULHEE to regain custody.
Kim Seoyeong, a lawyer from the corporation Shinsegae, appeared on the show and shared his opinions on the division of assets and child custody arrangements between MIN HWAN and YULHEE.
YULHEE married MIN HWAN in 2018 and had three children.
They divorced by mutual consent in February. At the time, YULHEE gave up custody of the children due to financial issues, and MIN HWAN was given custody of the three children. After that, there were complaints that YULHEE was to blame for the divorce.
As soon as the negative public opinion grew, YULHEE revealed on her YouTube channel 10 months after the divorce that MIN HWAN had been visiting entertainment establishments during his marriage and had been putting money into his pocket even in front of his family.
"The couple decided to end their marriage due to the above reasons. Since the revelation, Min Hwan has suspended all activities.
On this day, lawyer Kim stated that YULHEE had filed for divorce proceedings regarding alimony and property division.
Regarding the fact that the parties did not discuss the issue, the following was stated: "During the divorce process, a statement of the burden of child support will be prepared in negotiations regarding child custody and child support decisions, but alimony and property division will not be decided, and divorce proceedings will be conducted through negotiations.
"It is possible to get married," he explained, "The Civil Code stipulates that even if custody and care of children is decided at the time of divorce, this can be changed if necessary for the welfare of the children."
He continued, "If there was a clear agreement that the division of assets would be '0 won and no division would be made,' I think that the content is a little disadvantageous to (YULHEE).
"However, with regard to custody rights, since it is for the welfare of the child, even if an agreement has been reached, it can be changed if there is a reason," he emphasized.
Regarding custody rights, Min Hwan has been raising the three children for nearly a year, and Min Hwan's parents live in the same apartment and help with childcare.
Based on this, he said, "I think it is difficult to say for sure whether the children are being raised properly in the current circumstances, as there is a tendency to try to maintain a continuous nurturing environment."
Attorney Cho also said, "The court considers the parents' wishes regarding child custody to be very important. Therefore, the part where the parent waived custody rights during the divorce settlement is a little disadvantageous to YULHEE.
He added, "I think that in the current situation, it may not be easy to adjust custody rights," citing the need for continuity of the upbringing environment together with Attorney Kim.
However, they all agreed that Min Hwan's sex trafficking allegations could affect custody rights.
"If he is actually punished, it could affect his custody rights because it is related to a sexual offense," said Kim.
"It is because it is related to the welfare of the child," he said, "Even if Min Hwan does not have any income (since the sex trafficking allegations), (if YULHEE has custody) she will need at least 300,000 won (about 3 million won)."
"The sex trafficking part will have a big impact on custody rights, and YULHEE will be responsible for child support," Cho said.
"The situation is favorable for the court, but it would be difficult to completely determine custody and child rearing rights based solely on sex trafficking, so I think we need to wait and see how things go."
