Drunk Driving: Man and woman who switched drivers in accident both sentenced to prison in South Korea
A man and woman in their 20s who caused a drunk driving accident by crashing into a shopping mall and then tried to switch drivers were sentenced to prison.
On the 12th, the Cheongju District Court in South Korea arrested him on charges of property damage and obstruction of public duties.
The arrested man, Mr. A, in his 20s, was sentenced to two years in prison. In addition, Ms. B, a woman in her 20s who was charged with drunk driving and harboring a criminal, was sentenced to one year in prison without detention, but was not immediately detained.
The incident occurred at around 5:45 a.m. on April 29 in Deoksan-eup, Jincheon-gun, North Chungcheong Province. When the police arrived, Mr. A told them that he was the driver. As a result of the breathalyzer test, his license was revoked.
The results showed that B's blood alcohol level was 0.08%, which is equivalent to over 100% alcohol. Mr. A testified that he had drunk six bottles of soju and then drove about 20 kilometers with his girlfriend. As a result, Mr. B was not given a breathalyzer test.
However, when the police analyzed the surveillance camera footage, it became clear that the actual driver was not Mr. A but Mr. B.
After the two of them had been drinking at a restaurant, Mr. A initially drove about 100 meters. Then he said, "I'll teach you how to drive."
For this reason, he handed the driving over to Ms. B, who drove about 700 meters before the accident. Since Mr. A was the contract holder for the rental car, he made false statements in order to receive the insurance money.
He also faces other charges, including brandishing a 10-centimeter shard of glass at police officers at the scene of the crime.
The court ruled that Mr. A had been punished in the past for insurance fraud and obstruction of public duties.
The presiding judge said, "He has not shown any intention to comply with the law, such as threatening police officers and trying to switch drivers," and added, "He has confessed, but this is a repeat offense shortly after his release from prison.
The court also determined that Mr. B should be severely punished, but applied the favorable Widmark method to the drunk driving offense, finding that the punishment did not reach the threshold.
However, Mr. B was released without being detained due to the fact that he had paid compensation for the damage.
