A former idol group member who was indicted on suspicion of secretly filming sexual intercourse with his girlfriend had his sentence reduced in the second trial.
The first criminal appeals division of the Seoul Western District Court announced today that it will take measures to punish those who use cameras, etc., under the Sexual Violence Punishment Act.
The court overturned the first-instance ruling that sentenced a former idol group member, Mr. Choi (28), who was indicted on charges of filming and distributing pornographic material, to one year and six months in prison, and sentenced him to one year and four months in prison.
However, the court upheld the orders issued in the first trial, requiring him to complete a 40-hour sexual assault treatment program and restricting him from working in a child, youth, or disability-related institution for three years.
The court said, "Looking at the overall format of the filming and the results of the filming, it appears that the degree to which sexual embarrassment was induced increased."
However, the court said it took into consideration the fact that the footage had not been distributed and that it was a first offense. Choi paid a deposit for some of the victims, but this was because the victims refused.
