The exclusive contract dispute between South Korean girl group NewJeans and management office ADOR, a label under HYBE, has finally been left to the court to decide.
On the 3rd of this month, ADOR filed a petition for legal confirmation of the validity of its exclusive contract with NewJeans at the Seoul Central District Court.
The five members of NewJeans, Minji, Haerin, Hanni, Danielle, and Hyein, filed a lawsuit against the company last month.
On the 29th, they held a press conference announcing that they were terminating their exclusive contract with ADOR. ADOR was in breach of their obligations under the exclusive contract, and they did not correct this within the period of correction required.
The women's position was that they would not file a separate application for provisional disposition to suspend the exclusive contract, and that they were not obligated to pay any compensation for breach of contract.
However, while the remaining schedules are being completed as planned, the entertainment industry has been in a state of uproar.
The union also urged NewJeans to retract its current position and engage in dialogue with ADOR. The union said, "The intensification of the dispute will have a negative impact on Korea's pop culture and arts industry."
"If anyone can terminate a contract with just a declaration, how can the effectiveness of an exclusive contract be guaranteed? Who can invest in such an uncertain contract?
However, the difference in positions between the two sides could not be bridged, and the decision was left to the discretion of the court. ADOR said, "The issue with our artists is that the legal process is not possible.
Although we did not want the matter to be resolved through a judgment, many people, including the artist, understand that an exclusive contract between an agency and an artist cannot be easily terminated at the insistence of one side.
