Korea Football Association presidential election postponed, unprecedented situation... Court rules it is ”serious procedural irregularity”
An unprecedented event occurred in which the election for the president of the Korea Football Association was postponed to the day before the election. This was due to the postponement of the former national team coach, who was running for the 55th Korea Football Association president election.
The 50th Civil Division of the Seoul Central District Court on the 7th accepted the application for a provisional injunction to ban Heo Jung-moo from running in the presidential election against the Football Association.
The decision was made to approve the application for a provisional injunction to ban the move. As a result, the election for the president of the Football Association, which was scheduled to take place on the 8th, was halted the day before.
Following the court's decision, the Korea Football Association announced, "We would like to inform you that the election for the 55th president of the Korea Football Association will be temporarily postponed. Future plans
The court ruled that the ongoing election for the president of the Football Association had "significantly violated the fairness of the election and, as a result, affected the election procedures."
The court also pointed out that the majority of the electoral college is made up of a series of drawings that have not been verified as transparent or fair.
He further stated that because the identities of those appointed to the election management committee had not been made public, it was not possible to verify whether the committee was structured in accordance with the articles of incorporation and election management rules.
The Court considered that if the election were held, there would likely be subsequent disputes regarding its validity, and, having considered these points, found that the need to accept the application for provisional measures was justified.
On the 31st of last month, Candidate Huh filed an application for a provisional injunction to ban the election, claiming that the election was being conducted unfairly.
The election was conducted by direct vote only, which effectively excluded professional soccer coaches and players who were attending winter training camps, and the electoral college was made up of 21 fewer members than required, resulting in irrational election management.
The reason for the provisional injunction is that the election date is when most of the coaches and players of professional clubs will be overseas for training camps, so the candidate's side is planning to hold an online vote for absentee ballots.
However, the FA's election committee said that it would be difficult to guarantee a secret ballot through online voting, and that it was not possible to hold an online vote in the same way as other domestic sports organizations and top-ranking organizations such as the International Football Association (FIFA).
The request from the candidate Huh was not accepted because international organizations also conduct offline voting. In addition, the candidate Huh was dismissed from the electoral college after the Football Association's Election Steering Committee rejected his request for not submitting a consent form.
They also raised concerns that the Electoral College is made up of 173 members, 21 fewer than the 194 required by law, due to the exclusion of 1,000 votes.
Furthermore, candidate Huh said that the members of the Football Association's election steering committee had been made public.
According to regulations, more than two-thirds of the election committee members must be from academia, the media, the legal profession, or other fields unrelated to the Football Association.
Because the reasons for the exclusion are unclear, it is not even possible to confirm whether they fall under the grounds for exclusion. This raises suspicions that the election was unfair, according to Candidate Huh's side.
