South Korean President Yoon Seok-yeol filed a request for a legal review of his arrest at the Seoul Central District Court on the 15th, alleging that he was illegally arrested by the High-Ranking Public Officials Crime Investigation Agency.
It is noteworthy that the petition was filed at the Seoul Central District Court, not the Seoul Western District Court. President Yoon's legal team released a statement after the first interrogation by the Public Prosecutor's Office following his arrest, saying,
In a statement, the defense team said, "The Public Prosecutor's Office, which has no investigative powers, illegally entered the presidential residence and conducted an investigation into the president based on an illegal arrest warrant issued by a court that has no jurisdiction.
The defense team also emphasized, "The public prosecutors' office does not have the power to prosecute, and the Seoul Central Prosecutors' Office, which took over the case, will prosecute at the Central District Court, which is the corresponding court, so the Central District Court will be the one to prosecute."
The current measure is intended to prevent the Western District Court from questioning suspects before detention (substantive review of arrest warrants) and to determine whether or not an arrest has been made, in line with the Public Prosecutor's Office's plan to request a detention warrant in the future.
This is interpreted as a strategy to compete for power.
