If a person publishes false information about his/her career, etc., he/she will be subject to imprisonment of up to five years or a fine of up to 30 million won."
A petition for a ruling on unconstitutionality is a petition filed when the unconstitutionality of a law is the premise of a trial.
This is a system in which the court may apply for a constitutional review to the Constitutional Court on its own initiative or at the request of the parties involved. When the court decides on the application for constitutional review and sends a decision to the Constitutional Court, the Constitutional Court accepts it and begins the review process.
The case will be stayed until the Constitutional Court's decision. If the court rejects the application, the parties may file a constitutional petition with the Constitutional Court.
Meanwhile, on the 17th, Chairman Lee also submitted seven applications for witness testimony to the court. In response to Chairman Lee's actions, the ruling party and others have filed a petition for a review of the unconstitutionality of the law.
On November 15 last year, Lee was sentenced to one year in prison and two years of probation in the first trial for violating election laws.
If the Supreme Court upholds this ruling, Lee will lose his seat in parliament and his right to run for office will be restricted for the next 10 years, meaning he will not be able to run in the next presidential election.
