After the investigation by the Board of Audit and Inspection, it was revealed that he took measures such as resetting his mobile phone and returned it in November 2023, one year and eight months after his retirement.
Kim said, "I did not intentionally take the cell phone home. The item was unintentionally included when an employee was sorting through belongings at the official residence without permission."
However, the Board of Audit and Inspection pointed out that Kim's claims lacked credibility, as an official from the National Election Management Commission testified that "there is no such fact."
In 2019, Kim was accused of using influence to improperly hire his son as an 8th-class civil servant at the Ganghwa County Election Commission in Incheon.
He was indicted in December last year after being accused of tampering with the Constitution and Constitutional Law. The Board of Audit and Inspection's investigation also revealed that officials at the National Election Management Committee had referred to Kim's son as "Crown Prince."
The ruling People Power Party has intensified its criticism of the Election Commission, calling it a "corrupt cartel" over Kim's second phone controversy.

"Now that this fact has come to light, it is inevitable that the impeachment trial of (President Yoon Seok-yeol) will be resumed and evidence will be investigated into the Election Management Committee system," he said.
"The government's blind faith in the impeachment process led to the Board of Audit and Inspection being eliminated and all evidentiary procedures in the presidential impeachment process were rejected too hastily."
Former Chairman Han Dong-hoon also said, "The Election Management Committee, which has not been properly monitored, is now in a position where it has been subject to the Constitutional Court's decision.
