On the 21st, the 50th division of the Seoul Central District Court announced that ADOR was suing five "NewJeans" members.
The court granted the request for a provisional injunction to "preserve the status of the production company and prohibit the conclusion of advertising contracts, etc." The court cited a Supreme Court precedent, stating that if the trust between the contracting parties is broken, entertainers can terminate their exclusive contracts.
However, the court ruled that the person alleging the termination of the contractual relationship has the burden of proving that the circumstances have reached a level that makes it difficult to maintain the contractual relationship.
The five members of "NewJeans" announced in November last year that they would terminate their contract due to ADOR's violation of their exclusive contract, and began their own activities.
In January of this year, DOR filed an application for a provisional injunction to prevent the company from independently concluding advertising contracts with "NewJeans" members.
The purpose of the provisional injunction application was expanded to include a ban on music activities such as songwriting, composing, and singing, as well as other entertainment activities. All members attended the first provisional injunction hearing held on the 7th.
The five members stated that their relationship of trust had been broken and that they could no longer work with ADOR. Member Minzy said, "We can no longer work with ADOR, who bully us on a daily basis, and we will no longer be able to continue our activities or contracts with them."
"We have decided that it is impossible to fulfill the contract and have decided to terminate the contract. We hope that the court will consider our feelings," Daniel said. "No matter what the outcome is, we will continue to work with ADOR.
"We have no desire to do anything about it," ADOR said. ADOR, on the other hand, claims that the success of "NewJeans" was made possible by the full support of its parent company, HYBE, including an investment of 21 billion won.
OR countered, "It is absurd for a private company seeking profit to bury its own major source of income. The reasons asserted by the debtor for termination are meritless and have no relation to the main content of the exclusive contract."
ADOR's provisional injunction has been granted, putting a red light on NewJeans' independent activities. NewJeans will be holding the Complex Fashion Show in Hong Kong on the 23rd under the name NJZ.
ComplexCon had been scheduled to perform on stage at the event. Recently, ComplexCon announced on social media that tickets for the show on which NewJeans was the headliner were sold out.
