The Supreme Court overturned and remanded the case against Democratic Party presidential candidate Lee Jae-myung for allegedly violating the Public Offices Election Act, stating that he was guilty.
"The presidential election has reached a stage where it's worth giving it another try (for the conservative camp)," said Shin Byeong, a lawyer known for his work in the field.
On the 1st, lawyer Shin Byun posted a new title in his blog called "Stigma and Honor."
"On the 1st, the Supreme Court ruled that most of the statements made by the Democratic Party candidate Lee in the past that constitute the crime of publishing false facts under Article 250 of the Public Offices Election Act were false," said lawyer Shin.
The Supreme Court overturned the original acquittal and remanded the case to the Seoul High Court.
Candidate Lee was also found not guilty by the Supreme Court five years ago when allegations of publishing false facts under the Public Offices Election Act arose, but this time he was found not guilty and was revoked in about a month after the presidential election.
With the presidential election approaching, the second trial's acquittal was overturned, with the defendant found guilty. Regarding this, Shin said, "Although this Supreme Court ruling will not affect the upcoming presidential election, the significance of this is
"This is very serious," he said, explaining, "If the second-instance ruling, which was officially recognized as a mistaken verdict, were to be pronounced as normal, candidate Lee would be branded as someone who could not run in the presidential election."
He added, "Until now, the opposition party has succeeded in pushing candidates to the charge of 'civil war', and as a result, the ruling party candidate has not been able to erase the stigma of 'civil war'. Even if the declaration of emergency law on December 3rd is considered a civil war in academia,
Even if they claim that the predictions were inaccurate, the negative image of civil war that had been created up until that point was too strong," he said, diagnosing this as the reason for the conservative camp's drop in approval ratings.
"The outlook for the presidential election was bleak, but with this ruling, I was able to break through the thick clouds and find a small ray of light," said Shin.
"I can't say for sure how it will work, but at least we can have the same status in the presidential election," he said. At the same time, he said that in the world of politics, "justification" is the most important thing, and "I'm going to turn my inferiority
The power to overturn comes from a justification," he added. Shin concluded, "The progressive camp currently controls most of Korean society. This situation has only gotten worse since the presidential election.
However, there is a glimmer of hope that this possibility can be reversed," he said. "Now that candidate Lee has been heavily stigmatized and his reputation has been severely damaged, the presidential election should be held again.
"We have entered a phase that is worth watching," he emphasized.
