The court dismissed all charges and sentenced Yang to life imprisonment, the same as the original trial. It also ordered him to wear an electronic device for 20 years.
He is suspected of murdering a young man, Mr. A (31), and using the body's fingerprints to obtain a loan of 60 million won (approximately 6.3 million yen).
At the time, Yang, who was struggling financially, was not able to search for tools before the crime or abandon the body.
It was revealed that he had meticulously prepared for the crime, including purchasing the necessary items. After killing A with a murder weapon when she returned home, Yang wrapped vinyl tape around A's face and wrists and then took a knife.
He tried to wrap the body in a plastic bag and dispose of it, but gave up because the body was heavier than he had expected. Defendant Yang withdrew money from Mr. A's bank account and used the body's fingerprints to obtain a loan.
He continued to flee, using 60 million won for rental car and accommodation fees. After the crime, he also sent a message to A's parents who contacted him on his mobile phone saying, "I'm not at home."
He also pretended to be Mr. A. The prosecution had previously sought the death penalty, the maximum sentence allowed by law, for Yang in both the first and second trials.
The appeals court said, "The defendant's crime was extremely serious and he committed murder.
After the act, he showed no remorse and used the victim's money to achieve his financial desires, and showed a cruel attitude by abandoning the body." "However, he regrets his crime and is a first-time offender with no prior criminal history.
Taking into consideration these points, there will be no change to the sentencing conditions after the first trial," he said, explaining the reason for the sentence.
