According to foreign media such as the Associated Press, the Montenegrin Supreme Court invalidated the decision to deport him to South Korea and sent the case back to the original court.
The Gorica High Court will revisit the case, but it is expected to be difficult to go against the Supreme Court's interpretation of the law, as it is the highest court.
The Supreme Court's ruling came after the Supreme Prosecutors' Office previously filed an appeal against a lower court's decision to deport him to South Korea.
The Supreme Prosecutors' Office said that the decision of the extradition bureau is the sole authority of the Minister of Justice, but that the lower court exceeded its authority by deciding to deport him to South Korea, and requested the Supreme Court to rule on the legality of the decision.
"The Supreme Court's ruling reaffirms that the Minister of Justice alone has the legal authority to decide which country to extradite Kwon Do Hyoung to," the Ministry of Justice said.
Bloomberg News predicted that "the Supreme Court's ruling could mean Kwon will be extradited to the United States and put on trial in New York."
