“「冬のソナタ」OST参加”イルマ、元所属事務所に最終勝訴…遅延していた音源収益26億ウォンを受け取るか?
Yiruma, who participated in the Winter Sonata OST, wins final victory against former management office... Will she receive the delayed music revenue of 2.6 billion won?
Composer and pianist Yiruma won a lawsuit against the former management office and will receive his music revenue. On the 7th, according to multiple media reports, the Supreme Court's First Division (Chair: Seo Kyo-ho)
Supreme Court Justice Ngfang upheld the original ruling in favor of some of the plaintiffs in a lawsuit filed by Yiruma against his former management office, Stomp Music, over compensation.
In response, Yiruma won the final lawsuit against the former management office after six years, receiving 2.6 billion won (approximately 290 million yen) in music revenue.
Prior to this, in 2001, Yiruma signed an exclusive contract with the former management office Stomp Music. However, in 2010, he was forced to resign due to a breach of contract.
The company notified the former management office of the termination of the exclusive contract due to non-performance of accounting obligations, etc. Yiruma filed a lawsuit against the former management office to confirm the non-existence of the exclusive contract. At the time, Yiruma won in part, but in the appeal court, the two parties
The exclusive contract and copyright contract have been terminated. Additionally, Former Management Office has agreed to fulfill its obligation to pay distributions, including revenue from music releases.
However, Yiruma claims that the former management office will not be able to calculate and distribute future revenues from the copyrighted work.
In 2018, he filed a lawsuit against Yiruma for the compensation, alleging that the company had not paid the compensation in full. The former management office also fought against Yiruma's lawsuit.
Yiruma claims that he should receive 30% of the profits as specified in the exclusive contract.
However, the formermanagement office argued that it should only pay 15% of the profits because the copyrights had already been entrusted to Yiruma. The first, second and Supreme Courts ruled that the formermanagement office should pay 30% of the profits to Yiruma.
After six years, Yiruma finally won a lawsuit against the former management office, and will receive 2.6 billion won in music earnings.
