Company representative sentenced to two years in prison for violating Major Disaster Law... Death due to ignoring danger = South Korea
The president of a company that caused a fatal accident by ignoring safety inspections and continuing work despite the dangers identified during the inspection was sentenced to prison under the Serious Accident Punishment Act.
On the 8th, the Ulsan District Court in South Korea announced that it had sentenced Mr. A, the CEO of a mass production auto parts manufacturer, who was on trial for allegedly violating the Act on Punishment of Major Disasters, to two years in prison.
According to the Ulsan District Court, this is the heaviest sentence handed down to date in more than 15 first-instance rulings related to the law.
In July 2022, a Nepalese worker at mass production auto parts manufacturer A engaged in die casting (molten non-ferrous metal alloys).
A tragedy occurred in which a worker was killed after being pinched by a machine while cleaning the mold of the machine. Company A had previously received a warning from the Korea Industrial Safety Association, which was entrusted with safety inspections, regarding the protective device of some safety doors of die casting machines.
The safety gates of some of the die casting machines were damaged, and the company had received numerous reports that the risk of accidents was high and that the situation required immediate improvement.
A defect that caused the plant to not stop was discovered, but despite knowing this fact, Mr. A did not take any measures.
The court ruled, "The Korea Industrial Safety Association had pointed out the specific danger of the accident 10 days before it occurred, and yet the terrible accident occurred. If appropriate measures had been taken, the victims would not have been affected."
The victim would not have died, he said. He also explained the reason for the sentence, saying, "Even if an agreement is reached with the bereaved family and corrective measures are completed, we cannot give them a suspended sentence or other leniency."
The court sentenced the company's general director, Mr. B, who was indicted on charges of professional negligence resulting in death in relation to this case, to one year and six months in prison, and the company corporation, which was charged with the Serious Accident Punishment Act, to a fine of one
The ruling was made after the enforcement of the Major Accident Punishment Act, which has been in place since the Ulsan District Prosecutors' Office, the major industrial safety prosecutor's office, was established in the Ulsan and Yangsan areas.
This was the first time the case had gone to court.
