Perpetrator sentenced to six years in prison... Family of daughter who lost consciousness after being assaulted ”feels frustrated” - South Korea
A man in his 20s who indiscriminately assaulted a junior high school classmate, leaving him quadriplegic and unconscious, was sentenced to six years in prison. The victim's family expressed their anger.
On the 2nd, immediately after the Jeonju District Court handed down its sentence on the defendant Won (20), who was indicted on charges of serious injury, a group of people were killed at the home of the victim, Yeo (20).
"I never thought something like this would happen. I had faith in the courts, thinking they would produce a good outcome," said the man, who shed tears.
On that day, the court stated, "The victim, who was only 19 years old at the time, lost consciousness due to the defendant's crime," and "the victim absolutely needed artificial respirator and assistance from others to survive."
"One year and three months have passed since this incident, but if the defendant had sincerely apologized to the victim and her parents, he could have supported the victim's medical expenses through his monthly work," he said.
"However, the defendant has not even attempted to make amends for the damages suffered," he said. As for the reason for the sentence, he said, "The victim had been friends with the defendant since their junior high school days and had even traveled together.
"The defendant claimed that he "did not foresee that the victim would be seriously injured by the assault," but the victim in this case was not aware that the defendant had been so conscious of the fact that he had been in a close relationship with the victim.
"It is reasonable to think that it was not possible to predict that he would commit an assault," he emphasized. "The sentencing standard for the charge of serious injury should be one year and six months to four years in prison if special aggravating factors are applied.
"However, this is merely a general and objective standard and does not have legal force," he said. "Considering the fact that the victim was in a state of impaired consciousness and was vulnerable to crime,
The case began on the 5th of last month when Yeo's mother posted online, "Please help my daughter get over her regrets."
The mother said, "On February 6, 2023, my lovely daughter was traveling to Busan with her close friends in a fun and happy mood. She was assaulted by her friend and suffered traumatic cervical spine injuries.
She suffered a cerebral hemorrhage and is currently quadriplegic and unconscious." Regarding the circumstances of the assault, she wrote, "My daughter was arguing with her female friend when the assailant (a man) suddenly burst in and started verbally abusing her."
So when the daughter asked why he was using abusive language, he said it was because a big fight had started. "A big man (178 cm tall) assaulted my petite daughter (weighing 44 kg) not once, but twice.
"The prosecutor's request for a five-year sentence came as a shock to me on the day of the trial," the mother said.
My daughter only had 2-3 years to live at most." The mother posted another message the next day, saying, "We have filed petitions with the prosecutors and the courts every time, but the perpetrator has not even submitted a single letter of apology.
"It seems that he has not done so," she wrote, "and the cost of caring for my daughter is 4.6 million won (about 510,000 yen) per month. (But the assailant) is a bad person who doesn't even contact me."
The prosecution initially sought a five-year prison sentence for Won, but before the sentencing, they increased their request to eight years.
Prosecutors plan to review the sentence and appeal.
