The forklift driver, in his 30s, told police he caused the accident because he did not see the victim.
Due to Mr. A's death, the police have changed the charge against the forklift driver to violation of the Special Act on Traffic Accident Processing (causing death) and will continue their investigation.
However, the 12 major types of gross negligence under the Special Act on Traffic Accident Handling, which apply when hitting a pedestrian crossing a road, do not apply.
This is because university campuses are not considered roads under the Road Traffic Act, like roads within apartment complexes.
If a traffic accident is classified as one of the 12 major negligence cases, the driver will be subject to more severe criminal penalties regardless of whether or not a settlement is reached.
A police official said, "It is unlikely that this accident, which occurred on campus, falls under the 12 major negligence cases," and added, "We will conduct further investigations based on witnesses and other sources."
