He was sentenced and detained in court. When the court gave him an opportunity to make a statement before detention, A blamed the victim, saying, "At the time of the accident, my hazard lights were on, and three or four other cars avoided my car."
At around 6:40 a.m. on February 10th of last year, A was driving a freight vehicle near Gwangju-Muan Junction on the West Coast Expressway heading towards Seoul, and was not allowed to stop or reverse.
He was indicted on charges of causing a fatal accident through sudden, sudden actions. At the time, Mr. A was driving on the West Coast Expressway, and after passing the intended interchange, he stopped and reversed.
The driver, a man in his 50s, was driving a car at an extremely slow speed of 3km/h in an area where the minimum speed limit is 50km/h.
Mr. B found A's car almost stopped in the middle of the road and quickly stopped his car, but he was unable to avoid it. In the end, Mr. B was hit by the rear of A's car and died.
During the trial, A later admitted that "the engine suddenly stopped" and "if the driver had been looking straight ahead, the accident would not have happened."
However, the court did not accept this argument. The presiding judge said, "There was no way for the victim to avoid this accident, and the distance was insufficient and the impact strength was high.
"On the road, it is difficult to predict that the car in front of you will stop unless there are special circumstances," he said. "In the case of B dying in an accident where A violated his obligation to observe the minimum speed limit,
"We can acknowledge the causal relationship between the two," he said. "They later claimed that there was a vehicle malfunction, which they did not mention in the early stages of the investigation, but they have not provided any evidence to support this, and we cannot accept any other evidence."
There is also no evidence that the death occurred due to gross negligence, the crime was not light, no agreement was reached with the bereaved family, the family expressed their intention to refuse to receive the money even though the money was deposited in criminal court, and there is no special criminal history.
Taking these points into consideration, I will impose a prison sentence."
