Students at a national university have lost a lawsuit against their university for tuition refunds, claiming that the quality of classes has declined due to the COVID-19 pandemic, which has led to classes being conducted online.
On the 27th, the Seoul Central District Court dismissed all claims by students of Seoul National University and Incheon National University seeking partial refunds of tuition fees.
The court ruled in favor of the students who filed the lawsuit, but neither their lawyers nor the students themselves attended today's hearing.
The 2021 Tuition Refund Movement Headquarters filed a lawsuit in 2021, arguing that "even now, two years into the COVID-19 virus outbreak, universities are continuing to offer low-quality lectures, including online classes."
However, the court did not accept the lawsuit filed by the university students. Prior to this, about 2,600 students from private universities who had filed a lawsuit for tuition refunds for similar reasons lost both the first and second trials.
The students sued the university, claiming that they had gained unjust profits from tuition fees, school facility usage fees, laboratory and practical training fees, and student activity support fees, and demanded the return of these fees.
The first trial court ruled that the university's adoption of non-face-to-face classes was a minimum measure to protect the people's right to life and health.
The second trial court also ruled that "it is difficult to hold the schools legally responsible for conducting non-face-to-face classes.
The court stated that there was no evidence and that it was "unacceptable that the educational services that universities are supposed to provide to students are based on the premise of face-to-face classes," ruling against the plaintiffs.
The court handling the current lawsuit filed by the national university students is believed to have made a similar decision.
