Moon Geum-ju, a lawmaker from the Democratic Party of Korea, announced on the 2nd that she was the lead sponsor of a bill to partially revise the Criminal Code to punish the use of symbols of militarism.
Recently, there have been a series of cases of people flying the Japanese Rising Sun flag, a symbol of militarism, in apartment buildings and decorating cars, which has caused outrage among the public.
The current law does not provide a clear legal basis for restricting such behavior. The proposed amendments to the law include the prohibition of producing, distributing, or using in crowded public places or in areas where people live that are symbols of militarism, such as the Rising Sun Flag.
The law includes provisions imposing a fine of up to 20 million won on anyone who uses such advertising in public places where it is visible to others. The law also includes provisions prohibiting advertising that symbolize militarism, and local government leaders are required to take measures to prevent such advertising.
"The act of displaying symbols of militarism such as the Rising Sun Flag tramples on the historical legitimacy of the Republic of Korea and is a violation of our right to freedom of expression," Moon said.
"This is an unforgivable crime that desecrates the dignity of our people," he said, adding, "We need a strong deterrent in place to ensure that such symbols never appear in our society again under any circumstances."
Meanwhile, Germany prohibits the use of symbols against groups that violate the constitution through Article 86 of the Criminal Code, the so-called "anti-Nazi law."
