Even though nine people died... Attorney Han: ”The maximum five-year prison sentence for wrong-way drivers should be reviewed” - Korean media
As interest in the punishment of drivers following the "City Hall Station wrong-way driving accident" in which nine people were killed is growing, lawyer Han Moon-cheol said, "The sentences need to be increased for major accidents.
"Even if there are many victims, five years in prison is the maximum sentence," Han explained on his YouTube channel, "Han Moon-cheol TV."
"If it is determined that the accident was caused by the driver's negligence, the driver will be sentenced to up to five years in prison," said Han. "We are proceeding with settlement negotiations smoothly with all the bereaved families.
"If the defendant is found guilty, he may be given a suspended sentence on appeal, but such cases are rare," he said. "We cannot impose a heavier sentence than the current law. We cannot impose a heavier sentence than the current law.
"We need to enact a special law like the 'Police Inspection Law' or amend the criminal code, but amending the law is not easy," he added.
He continued, "No matter how many people die, the pain of the bereaved families is indescribable, but in the case of a major accident,
"There is a need to further increase penalties," he said, adding, "I think it is necessary to consider the sentencing standard of 'a maximum of five years in prison.'"
"If it turns out that the cause of the accident was sudden acceleration, Cha may be found not guilty," said Han.
"There needs to be evidence such as a black box that can prove the sudden acceleration and why the brakes didn't work at the time of the accident. Without this, it will be difficult to prove."
On the 1st of this month, at the intersection of Seoul City Hall Station, a car driven by suspect A (68) left the underground parking lot of the Westin Chosun Hotel, drove down a one-way four-lane road in the wrong direction, and crashed into the left-hand sidewalk.
The accident left nine civilians dead and seven injured.
