Recently, a video of a woman in her 20s undergoing an abortion while nine months pregnant was released, sparking controversy, and the government has asked the police to investigate her on suspicion of murder and other offences.
Under the Maternal and Child Health Law, abortion after the pregnancy is illegal, but since the criminal offense of abortion under the Criminal Code has been abolished, it is in effect ineffective. As a result, there have been cases in which doctors who aborted 34-week fetuses were charged with murder.
On the 27th of last month, Ms. A posted on her YouTube channel, "The total cost of surgery was 9 million won (approximately 1.02 million yen), and it was a hellish 120 hours."
She posted a video with the title "Abortion Vlog" in which she said she had undergone an abortion surgery when she was 36 weeks pregnant. The video was then uploaded to several internet sites under the name "Abortion Vlog" and other names.
The post spread throughout the community, sparking controversy as it suggested that undergoing an abortion at 36 weeks' pregnant was, in effect, "fetal murder."
The Ministry of Health and Welfare then discussed the matter and performed surgery on Mr. A and Mr. A on the 12th of this month.
The government said it had filed a petition with the Seoul Metropolitan Police Agency on charges of murder against the doctor. Under the current Maternal and Child Health Law, abortions can only be performed within the 24th week of pregnancy, and only if the woman or her spouse has a genetic disease.
It is only permitted in some cases, such as when the pregnancy is the result of rape or when continuing the pregnancy would seriously harm the mother's health.
However, since the Constitutional Court ruled that the criminal offense of abortion under the Criminal Code was unconstitutional, abortion, which is not permitted under the Maternal and Child Health Law, has become illegal.
There is virtually no punishment for the surgery. This is the first time that the Ministry of Health and Welfare has taken the step of directly requesting an investigation into a case in which a woman was in the final month of pregnancy.
A Health and Welfare Ministry official said, "After verifying the facts, such as whether an abortion was actually performed, we will petition the Seoul Metropolitan Police Agency for legal review."
"In the past, a doctor who was indicted on charges of aborting a 34-week fetus was found not guilty of professional abortion but guilty of murder, so I'd like to refer to a case in which the doctor was found not guilty of professional abortion.
