”Happy birthday” anonymous email sent in the middle of the night...even ”underwear delivery” = Korea
A man who sent a woman birthday message in the middle of the night while concealing his identity and had underwear delivered to her home as a gift has been found guilty of stalking at a second trial.
According to legal circles, on the 20th, the Seoul Central District Court imposed a fine of 3 million won (approximately 34 million yen) on Defendant A (30), who was indicted on charges of violating the Stalking Crime Punishment Act, the same as in the first trial.
The court sentenced him to 10,000 yen and ordered him to complete a 40-hour stalker treatment program. At around 4 a.m. in February 2022, Mr. A sent a message to Mr. B, who runs the sports facility he attended, saying, "Birthday
Happy birthday." Five days later, around 3:00 a.m., Mr. A sent another message to Mr. B. "How was your birthday today? I was at the front door this afternoon.
Please check the front. Please wear it neatly.' A set of women's underwear was actually delivered to Mr. B's home.
During this process, Ms. A did not reveal her true identity to Ms. B. Ms. B immediately took the underwear set.
After returning the item, he tried to contact A, but was told that the number did not exist. A, who was indicted on charges of stalking, said, "I wanted to celebrate his birthday in secret, and it was just a misunderstanding caused by cultural differences.
He claimed innocence, saying he had not committed any crime, but the court of first instance pointed out that "the series of actions committed by Mr. A were objectively sufficient to cause the other person to feel anxiety and fear."
The court heard, "She received repeated messages every few days from a stranger in the middle of the night, and the messages included personal information about her, such as her age and date of birth.
"The message contains sexually explicit information," he said, adding, "It is clear that the act of giving underwear as a gift without revealing who you are is likely to cause discomfort."
Mr. A appealed, but the second instance court dismissed the appeal, finding that the original court's decision was not erroneous.
