South Korea's ruling and opposition parties move to amend espionage law... Will scope of application be expanded from enemy countries to foreign countries?
In the South Korean National Assembly, a bill to amend the espionage law has been submitted by both the ruling and opposition parties. The common goal of these bills is to expand the scope of crimes from enemy countries to foreign countries.
As a result, espionage by countries other than North Korea may also be subject to punishment. According to the National Assembly's bill information system on the 5th, the 22nd National Assembly has passed the Espionage Act (Article 98 of the Criminal Code).
Seven amendment bills have been proposed, four from the main opposition Democratic Party and three from the ruling People Power Party. Three of the seven bills were proposed after a military officer from the Defense Intelligence Command was arrested at the end of last month for allegedly assaulting the South Korean military.
The proposal was made after a case involving the leaking of military secrets, including the personal information of intelligence agents, to Chinese citizens was reported in the media.
The bill expands the scope of the law to include "a foreign country or foreign organization." The bill also stipulates that those who leak military secrets to allies or friendly nations that are not enemies should be punished as espionage criminals, just like in other countries.
The amendment proposed by Rep. In Yo-han of the People Power Party would make the leaking of not only military secrets but also national core technology and defense industry technology punishable as espionage.
The bill includes provisions that would amend the Espionage Act. Several bills to amend the Espionage Act were submitted to the previous 21st National Assembly, but they did not pass the deliberation of the National Assembly Legislation and Judiciary Committee, the standing committee in charge, and were discarded when the term of the committee expired.
On the 1st, People Power Party leader Han Dong-hoon said, "If the Democratic Party of Korea votes in favor, the amendment to the espionage law that changes the term from enemy country to foreign country will definitely pass," and called on the Democratic Party of Korea to approve the amendment.
The government is calling for cooperation in making the amendments.
