「性的暴力被害」として虚偽告訴した20代女性...示談金3000万ウォンを受け取って罰金700万ウォンを宣告
A woman in her 20s who falsely accused a man of sexual violence received a settlement of 30 million won and was fined 7 million won.
A woman in her 20s has been sentenced to a fine after falsely filing a complaint alleging that she had consensual sexual relations with a man she met on a dating app, but was suddenly sexually assaulted.
On the 8th, the Busan District Court in South Korea sentenced a female suspect, A, who was indicted on charges of attempted blackmail and false accusation, to a fine of 7 million won (approximately 740,000 yen), the same as the original sentence.
On September 10, 2022, suspect A stayed at a hotel in Haeundae, Busan with a man in his 30s, Mr. B, whom he met through a dating app, and then consensual sex with him.
They had a sexual relationship. After that, when B returned from running errands, suspect A left the room, but when he did not contact her and refused her request to extend her stay at the hotel, he began to threaten her.
It was reported that suspect A also sent a message stating, "If you do not give me 1 million won (approximately 106,000 yen), I will report you for sexual assault."
When Ms. B refused, Suspect A filed a complaint stating, "Despite my clear intention to refuse, I was subjected to forced sexual violence and I would like the assailant to be severely punished."
The court said, "The crime of false accusation is a serious crime that may subject the victim to unjust punishment, so the crime is serious," and "However, if the defendant pays 30 million won (approximately 318,000 yen), the amount will be increased."
The court explained its reasons for the sentence, saying it took into consideration the fact that a settlement was reached by paying the victim 20 million yen (100,000 yen), that the blackmail crime was unsuccessful, and that the sexual assault charges were dropped.
