The detention period of trot singer Kim Ho-Jun (32), who was arrested and indicted on charges of hit-and-run and other offenses, has been extended by two months.
According to the Korean legal profession on the 17th, the Seoul Central District Court issued a special
Kim Ho-Jun, who is suspected of violating the law on aggravated punishment of fixed crimes (dangerous driving causing injury and fleeing causing injury), not taking measures after an accident under the Road Traffic Act, and aiding and abetting the escape of a criminal, has been detained for two years.
Prior to this, after Kim Ho-Jun was arrested and indicted on June 18th of this year, the court extended his detention period once on August 12th, and it was scheduled to expire on the 14th of this month.
According to the Criminal Procedure Code, a defendant's initial detention period is two months, which can be extended twice for two months up to a maximum of six months.
Kim Hojun was arrested for drunk driving at around 11:40 pm on May 9th in Apgujeong, Gangnam-gu, Seoul.
He is suspected of taking no action and fleeing the scene after crashing into a taxi in the oncoming lane (no action taken after the accident). In the early hours of the following day, he was asked to turn himself in as his own place by his manager, Mr. Chang.
Kim Ho-jun, who turned himself in to the police 17 hours after the incident, was accused of intentionally drinking more alcohol to avoid being punished for drunk driving.
The prosecution said Kim Ho-jun was drunk and had difficulty driving normally, but that he could not be charged with drunk driving because they could not clearly determine his blood alcohol level at the time of the accident.
At the closing hearing held on the 30th of last month, the prosecution sought a prison sentence of three years and six months for Kim Ho-jun, stating that he "has engaged in severe negligence and systematic obstruction of justice, provoking public outrage."
Kim Ho-Jun applied for bail on August 21 after his detention period was extended. The prosecution responded, "There was no special change in the circumstances, and he committed this crime to avoid punishment.
"There is a high risk of flight, so we request that the case be dismissed," he said. Meanwhile, Kim Ho-jun's lawyer said that Kim Ho-jun's congenital ankle pain had worsened during his incarceration and that he needed treatment, and so he requested bail.
On that day, Kim Ho-jun entered the courtroom dragging one leg on crutches and read his prepared final statement. "I am truly sorry and remorseful to the victim.
Kim Hojun began by saying, "I regret and reflect on the choice I made that day. Rather than a life of doing good things, I will strive to live a life in which I do not repeat the same mistakes. I will be determined to keep my resolve strong."
"I will live an upright life," he said. The court set the sentencing date for Kim Ho-Jun for November 13. It did not disclose whether bail will be granted or when it will be decided.
With Kim Ho-Jun's detention period extended until mid-December, it is likely that he will remain in prison until his sentencing date.
If the court issues a prison sentence, he will remain in custody, but if it gives him a suspended sentence or a fine, Kim Ho-ji will be sentenced to 10 years in prison.
