After driving a vehicle, a person consumes additional alcohol or uses medicines or other items that may affect the blood alcohol concentration, as specified by the Ordinance of the Ministry of Interior and Safety, with the intent of confusing the breathalyzer test.
The legal penalty for those who obstruct the breathalyzer test is the same as for those who refuse the breathalyzer test: imprisonment for one to five years or a fine of 5 million won (approximately 500,000 yen) or 2 million yen (approximately 500,000 yen).
The law stipulates that a fine of up to 10 million won will be imposed on drivers who have failed to take a breathalyzer test. In addition, those who have failed to take a breathalyzer test will also have their driver's license revoked, and the disqualification period for re-obtaining a license will be the same as that for those who refuse to take a breathalyzer test.
The amendment was prompted by the drunk driving hit-and-run accident that occurred earlier this year involving singer Kim Ho-jun. Kim Ho-jun was killed in a hit-and-run accident in Seoul late on May 9th.
He is accused of crashing into a taxi coming from the opposite direction while driving on a road in Sinsa-dong, Gangnam-gu, and then fleeing the scene.
The investigation revealed that Kim HoJun bought and drank canned beer after the accident.
When this was revealed, suspicions were raised that the "drunk driving" technique may have been used, as Kim Ho-jun turned himself in to the police 17 hours after the accident occurred.
After that, the prosecution decided that it would be difficult to determine the amount of alcohol consumed at the time of the accident, and decided to file charges of dangerous driving causing injury and escape under the Act on Aggravated Punishment of Specified Crimes, excluding the charge of drunk driving.
Kim Ho-Jun was handed over to the trial on charges of driving causing injury and failing to take measures after an accident under the Road Traffic Act. Kim Ho-Jun was sentenced to two years and six months in prison at the first hearing held on the 13th.
"In light of his overall behavior, such as leaving a false conversation after escaping to the motel and buying a beer before entering the room, he did not seem to have any guilt for the mistake he made as an adult.
"I question whether he was guilty," he said, pointing out that the circumstances after the crime were also poor. Meanwhile, Kim Ho-Jun immediately filed an appeal after the first trial handed down its sentence.
