The sentencing hearing for the appeal trial of Kim Ho-Jun, who was indicted on charges of violating the Act on Aggravated Punishment of Fixed Crimes (dangerous driving causing injury), will be held.
Kim Hojun was arrested at around 11:44 pm on May 9th last year at Akjo, Gangnam-gu, Seoul.
Kim Ho-jun was drunk when he crashed his car into a taxi on the opposite lane on a road in Apgujeong-dong and fled the scene. Kim Ho-jun fled to a hotel in Gyeonggi-do and then falsely turned himself in to a management office employee.
He tried to hide the crime multiple times, including by not providing the PIN numbers to the police who confiscated his three mobile phones. After that, he turned himself in for questioning by the police 17 hours later.
Prior to this, Kim Ho-Jun was sentenced to two years and six months in prison in the first trial in November last year. However, both Kim Ho-Jun and the prosecution appealed the decision.
The lawsuit was filed on suspicion of drunk driving, where the suspect deliberately drank more alcohol to avoid taking a breathalyzer test after the accident.
"If I was preparing for a criminal conviction, I would drink stronger alcohol," he said. "It was very wrong to not say that I had been drinking, but I hadn't even considered the tactic of getting drunk."
At the closing hearing held last month, the prosecution asked for the appeal to be allowed, and sought the same sentence of three years and six months as in the first trial. On the other hand, Kim Ho-Jun's side admitted that he had drunk driving, but said that it was not a serious offense.
He emphasized that the crime did not fall under the category of dangerous driving resulting in injury, which occurs when there is excessive confusion. Kim Ho-jun, who made the final statement, also said, "I am sincerely sorry for causing social controversy," and "I will never be able to erase the crime I committed."
However, I will use this incident as a turning point and help him live a new life different from before." According to the legal community, Kim Ho-Jun said,
So far, he has submitted an additional 34 pages of letters of apology. It is known that he had previously written 100 pages of letters of apology up until the day before the trial date, but it has now been revealed that he has written an additional 34 pages.
