The second hearing of the appeal trial for Yu A In, who was indicted on charges of violating the law on sexual intercourse (sexual intimidation), will be held. Prior to this, Yu A In was found guilty of using propofol and other drugs between September 2020 and March 2022.
He is suspected of using the drug 181 times and of illegally being prescribed sleeping pills under other people's names 44 times between May 2021 and August of the following year.
After taking over the case from the police in June, the prosecution said Yu A In had instructed an acquaintance to destroy evidence.
In the first trial, Yu A In was sentenced to one year in prison, fined 2 million won (approximately 218,000 yen), and fined 1.54 million won (approximately 168,000 yen).
She was sentenced to a fine of 1,000 yen and detained in court. However, she was found not guilty of the charge of inciting the destruction of evidence due to a lack of evidence. Both Yu A In's side and the prosecution appealed.
At the second hearing, Yu A In's lawyer said, "The original sentence was excessively severe," and "The defendant was not able to overcome the weakness of the law and regulations.
He did not maliciously violate the rules by taking advantage of the situation, but rather developed a dependency on the sleeping anesthetic when he was already in an extremely physically and mentally extreme situation."
"Even before the investigation began, he had been visiting a psychiatric clinic to try to resolve his sleep disorder.
It was a situation in which we could actually enjoy a considerable effect," he added. Yu A In did not make any particular statement.
The court has decided to hold another hearing to hear additional arguments from both sides, and attention is focused on what will be exchanged.
