However, in the second trial, the driver was found not guilty of intentionally fleeing the scene of the accident, and his sentence was reduced to 10 years in prison. A woman in her 20s was rendered brain dead by the accident and later died.
On the 20th, the Supreme Court of Korea upheld the original ruling that sentenced the defendant Shin (28), who was indicted on charges of violating the Act on Aggravated Punishment of Certain Crimes (escape resulting in injury), to 10 years in prison.
On August 2nd of last year, at around 8:10 pm, Shin was driving a Rolls Royce on a road near Apgujeong Station in Sinsa-dong, Gangnam-gu, Seoul when he ran onto the sidewalk and hit a passerby (who was a pedestrian at the time).
He was indicted on suspicion of fleeing the scene without providing medical treatment to a 27-year-old man who was injured in the act. The victim, who was brain dead, died on November 25 last year, and the charges against Shin were changed from fleeing resulting in injury to fleeing resulting in death.
The first trial sentenced Shin to 20 years in prison, but the second trial reduced the sentence to 10 years. The second trial did not prove that the driver had intentionally fled the scene, and he was found guilty in the first trial.
He was found not guilty of charges of fleeing the scene resulting in death and failing to take action after the accident, and was found guilty only of two charges: dangerous driving resulting in death and drug driving under the Road Traffic Act, and his sentence was reduced to half of that of the first trial.
Shin was also indicted separately on charges of habitual use of psychotropic drugs and was sentenced to two years in prison in the first instance.
