The National Assembly passed the bill to amend the rules regarding the composition and operation of the Special Prosecutor Candidate Recommendation Committee at a plenary session that afternoon, with 179 in favor and 102 against of the 281 members present.
The Democratic Party of Korea has been pushing ahead with the Special Prosecutor's Bill for Mrs. Kim Gun-Hee, which was scrapped after President Yoon Seok-yeol exercised his right to request a second vote and then revoted.
The party has brought up the idea of a permanent special prosecutor, with the calculation that such a body would be subject to the law on the appointment of special prosecutors and would not be subject to a veto.
However, the Permanent Special Prosecutor Act requires the establishment of a special prosecutor candidate recommendation committee in accordance with the National Assembly rules.
Under the proposal, three of the seven recommending committee members would be the Vice Minister of Justice, the Deputy Chief of the Courts Administrative Office, and the president of the Korean Bar Association, with the remaining four being recommended by the first and second negotiating groups of the National Assembly, two each.
The Democratic Party of Korea pushed for the rule change, arguing that such rules would likely lead to the creation of an independent investigation committee that is favorable to the government and ruling party.
The main point of the amendment passed on that day is to remove the right of recommendation from the political party to which the president belongs or previously belonged if the person in question commits an illegal act and becomes the subject of investigation.
The revised bill allows two non-negotiating groups with the most members to nominate one candidate each, and if the two groups have the same number of members, the non-negotiating group with the most number of elected representatives will be the one to nominate.
In the 22nd National Assembly, the Democratic Party has the right to recommend two candidates, the Fatherland Reform Party one, and the Progressive Party one.
