Defendant A, a foreigner in his 50s, was sentenced to three years in prison on charges of violating the law (flee resulting in death) related to theft and other crimes. Defendant A was arrested in July this year after discovering that a 2-year-old man had fallen on the road while driving in a residential area of Ulsan.
He was on trial for allegedly hitting a teenage woman, Ms. B, with his car and then fleeing the scene. Ms. B suffered serious injuries to her abdomen and legs and was taken to the hospital, but died three hours after the accident.
During the trial, Defendant A argued that at the time of the accident, it was the middle of the night and he could not see Mr. B, and he thought he had stepped on something like a futon, but did not realize that it was a person.
However, the court did not accept this argument, citing the condition of the road where the accident occurred and Defendant A's behavior after the accident.
In addition, CCTV footage from around the scene showed that the defendant's car was shaking up and down violently at the time of the accident, and that the defendant was about 30 meters away from the accident site.
The court determined that Defendant A was aware of the accident, citing that after parking in a vacant lot, he got out of the car and looked at the bottom of the bumper for about a minute.
The investigation agency's on-site investigation and the Korea Road Traffic Authority's accident analysis also pointed to Defendant A.
The court ruled that the accident occurred because the defendant was not looking ahead properly, and that a settlement had not been reached with the family members.
"We also took into consideration the fact that the victim, who was drunk and fell onto the road, was also significantly at fault in causing the accident," he said, explaining the reason for the sentence.
