Prosecutors reject police request for military search of home: ”We are already investigating” - South Korea
The Seoul Central District Prosecutors' Office in South Korea explained the reasons behind its rejection of a search warrant applied for by police to search the homes of military units in connection with the state of emergency incident on December 3rd.
On the 11th, the Seoul Central District Prosecutors' Office said, "Police warrant applications related to emergency martial law cases are handled by a separate dedicated department independent of the special investigation headquarters.
The prosecution cited two reasons for rejecting the search warrants for the Special Warfare Command and the Capital Defense Command.
The first reason is that the military court has jurisdiction under Article 2 of the law, and the military prosecutors dispatched to the special investigation headquarters of the prosecution are already conducting an investigation into the subject. The second reason is that
The fact that there is a precedent for the court to reject a warrant for a military officer on active duty due to concerns about duplicate investigations.
"The warrant was dismissed because it was deemed unnecessary and inappropriate due to jurisdiction issues and concerns about overlapping investigations," the National Police Agency's National Investigation Headquarters' Special Martial Law Investigation Team said on the 9th of this month.
Search warrants were applied for at a total of six locations, including the Seoul National Police Agency, the National Assembly Security Guard, the Special Warfare Command, and the Capital Defense Command, but two military-related warrants were rejected, meaning searches were only conducted at four locations.
The prosecution emphasized, "We are fully aware of the seriousness of the case and are reviewing and processing all police application warrants as quickly as possible."
Regarding the state of emergency, investigations are ongoing between the prosecution, police, and the High-Ranking Public Officials Crime Investigation Agency.
Amid a battle for leadership in the investigation, the National Police Agency's National Investigative Headquarters, the High-Ranking Public Officials Crime Investigation Agency, and the Defense Ministry's Investigation Headquarters agreed to operate a "Joint Investigation Headquarters."
All parties involved, except for the prosecution, have joined forces.
