On December 27, 2023, the Gwangju District Prosecutors' Office in South Korea arrested and indicted the biological mother A (25) on suspicion of throwing her 6-month-old daughter out of a window and killing her.
At around 6:20 a.m. on the 3rd of the same month, A threw her six-month-old baby through a window from the 15th floor of an apartment in Geumho-dong, Seo-gu, Gwangju.
A and her husband were often at odds over financial issues. On the day of the incident, A had been drinking and had been fighting with her husband. When her husband left the house, A, in a fit of anger, threw her daughter into the house.
It was determined that she threw her daughter out of the balcony window of a 15th floor apartment building. Before the crime, A called her husband and said, "I'm going to throw my daughter out," but her husband didn't believe it and just ignored her.
When the husband returned home, he realized that his daughter was not there and called the police. The girl was found by a resident on the first floor and was taken to the hospital by fire authorities, but died.
They were arrested red-handed. On the 1st of the same month, the couple had a quarrel and was reported to the police for domestic violence, but the couple made it clear that they had no intention of being punished by the police, so the case was not made into a crime.
A's legal representative admitted to the charges in court, but argued for a reduction in the sentence because A was receiving psychiatric treatment for depression and other conditions. A's husband also felt a deep sense of responsibility.
The first-instance court ruled that "he brutally murdered his six-month-old daughter and deserves aggravated punishment," but also noted that "he suffered from depression and did not consider his husband's responsibility as his motive for the crime."
The prosecution immediately appealed, seeking a 20-year prison sentence for A. At the appeal hearing, A said, "What crime did you commit?"
"I will atone for my sins so that when I meet my lost child in heaven, I can ask him to forgive his mother," he said, drawing criticism. The appeal court handed down the same seven-year sentence as the first court, and A was ordered to serve 10 years in child-related institutions.
The appeals court ordered the employment restriction of the defendant. The court stated, "The defendant killed the victim whom he should have protected, and the crime is extremely serious. We acknowledge that the defendant was in a mentally and physically weakened state at the time of the crime, but we cannot accept this fact.
"Therefore, I will not reduce the sentence," he said. He continued, "The defendant suffered from depression and frequently had conflicts with her husband, and the crime was committed accidentally. The defendant's husband, who is the victim's father, wanted leniency, so I will not reduce the sentence."
Taking all these factors into consideration, the sentence handed down by the court below is just."
