As the prosecution requested an extension to the detention period for President Yoon Seok-yeol, who is accused of leading a civil unrest, his legal team expressed the position that the detention should be lifted.
The government is arguing that the correct procedure is to proceed with the criminal trial while watching the impeachment hearing at the Constitutional Court, since maintaining the detention period means that indictment is planned.
Yoon Kap-keun, a lawyer for President Yoon Seok-yeol's legal team, said on the 24th, "Maintaining the detention of the president means that indictment is planned during the detention period."
"This means that the prosecution acknowledges that the Public Prosecutor's Office is conducting illegal investigations, and that the prosecution will play a role in assisting the Public Prosecutor's Office."
Attorney Yoon Gab-keun said, "The prosecution is not a party to the investigation.
"They must ignore the evidence and start the investigation into the president from scratch again," he said. "Due to the illegal investigation and illegal arrests by the Public Prosecutors' Office, all evidence has been lost, and any investigation results will not be recognized as legally legitimate."
"Furthermore, if the prosecution continues to hold the president in custody, it will be an obstruction of the president's right to defend himself in the impeachment trial, which is as important as a criminal trial."
"This is not merely a matter of the president's personal human rights, but a national issue that obstructs the review of the constitutional meaning of the declaration of martial law," he said.
Attorney Yoon Gap-keun said, "Since the National Assembly prosecution side excluded the crime of treason from the grounds for indictment,
"We must also be extremely careful when making a criminal judgment on the crime of treason," he said, explaining, "The correct procedure is to proceed with a criminal trial after a hearing on the president's constitutional decision to declare martial law."
Finally, it added, "The Seoul Central District Court should also not approve the application to extend the period of the arrest warrant issued by the Seoul Western District Court."
The prosecutors' special investigation headquarters for emergency martial law filed a petition with the Seoul Central District Court on the previous day requesting an extension of the detention period for President Yoon Seok-yeol.
If the extension is granted, the prosecution is expected to begin a face-to-face investigation of President Yoon Seok-yeol as early as this weekend.
