In December 2022, Mr. A purchased the work "I Thought" at MINO's (WINNER) first solo exhibition for 25 million won (approximately 2.5 million yen).
The plan was for the work to be received around February 2023 after the exhibition ended, but the gallery delayed the delivery due to overseas exhibition schedules and other reasons.
Afterwards, the curator, Mr. A, changed his position, saying, "MINO (WINNER) does not want to sell the work," and gave him a similar painting that he had newly created.
However, it was revealed that MINO (WINNER) decided to give the painting to a famous female singer. The gallery explained that they had received a pre-order without first receiving confirmation from the artist during the consignment sale process.
In the end, Mr. A filed a civil lawsuit claiming that he had paid but had not received the work. In the first instance, the court ruled that the painting should be handed over to Mr. A, and that if the painting could not be handed over, the court would suspend the litigation.
The court ruled that the money should be paid. Mr. A claimed that the lawyer's fees alone cost him at least 20 million won, and that he also paid other expenses such as preparation costs for the lawsuit and compensation for mental damages.
In addition to the damages, he requested a settlement of 40 million won, but the court rejected this request in the second instance. Mr. A is said to be considering filing an appeal.
In response, MINO (WINNER) said through the "case chief" that they "did not even know that a lawsuit had been filed."
The gallery responded, "At the time, a curator with little experience made a mistake," and "instead of handing over the work to the buyer, we offered a refund. The buyer made an unreasonable request.
" MINO (WINNER) will begin serving as a social service officer in March 2023 and complete his service in December 2024. However, just days before his release from conscription, he was found not to have performed his duties properly.
In response, the Military Manpower Administration asked the police to investigate, and on the 23rd, Mapo Police Station in Seoul summoned and investigated MINO (WINNER) on suspicion of violating the Military Service Act.
MINO (WINNER) reportedly stated that he worked legitimately.
