The Constitutional Court of Korea held the sixth hearing from 10 am to 6 pm on the 6th.
The head of the task force, Kim Hyung-tae, former commander Kwak, and Park Chun-seop, the president's chief economic adviser, attended the hearing.
On December 6 last year, former Commander Kwak appeared on the YouTube show of Democratic Party lawmaker Kim Byung-ju and said that he had been working with the president for one day.
On December 9, during the investigation by the prosecution, he submitted a confession stating that "the president opened the door and ordered me to take him out."
When he appeared at the status questioning session, he said he made two phone calls, and in the second call in particular, he testified that "the president gave the order to 'break down the door, get in and drag out the members of Congress.'"
The indictment for former Commander Kwak states that he told Kim and the 1st Airborne Brigade Commander, Lee, to "break the glass and break into the National Assembly building," and that "150 National Assembly members will be arrested."
He is reported to have said, "Do not cross the threshold," "We must break down the doors of the main chamber and get in there and drag out the members of parliament," and "This is the president's order."
Constitutional Judge Jung Hyun-sik said to former Commander Kwak, "Apart from the interpretation of the witnesses,
"I asked him about the instructions he had received that day. At around 12:30 a.m. on December 4, President Yoon called him and said, "It seems the number of people required for the resolution has not been met.
"Go in and drag out all the people inside," he testified. He also testified that Defense Minister Kim Yong-hyun gave additional instructions over the phone from 35 minutes into the game, but he doesn't remember exactly when.
Former Commander Guo said that he interpreted the word "personnel" to mean members of the National Assembly based on the situation at the time. At the time, former Commander Guo was watching the situation on the monitor in the command and control room and saw "the left side of the screen
"The instructions left an impression on me when the National Assembly Speaker and other personnel were on TV. I clearly understood that they were from National Assembly members," he said. After that, from around the 35th minute, Defense Minister Kim made multiple phone calls to former Commander Kwak,
President Yoon also testified that he received instructions along the same lines. After the questioning of former Commander Kwak, President Yoon directly expressed his views. President Yoon said, "The fact that he said to drag out the lawmakers means that he was in a position to be a lawmaker.
"I understood that," he said, "and that's what I understood. It was not a word I used," he said, emphasizing, "They say I said 'personnel,' but I have never used the word 'personnel' in reference to people."
He added, "If I had given strong instructions, I or the minister would have called at least once or twice to confirm. This is completely out of common sense," and added, "I would like you to view this within the bounds of common sense."
Meanwhile, during the witness examination that morning, Kim testified that he had never received an order from former commander Kwak to "drag out the congressman." Kim said, "I never received an order from Kwak to 'drag out' or '
"I don't recall hearing the instruction 'Diet member,' but I understood it to mean that I should get into the Diet quickly."
