On January 1 last year, Mr. A was on a T'way Airlines flight that was scheduled to depart from Vietnam's Cam Lam International Airport and arrive at Incheon International Airport.
As the captain of flight W158, I was inspecting the aircraft before departure when I noticed a Brake Wear Indicator pin
The Air Force discovered that the brakes on the aircraft were worn out and claimed they could not depart until the brakes were replaced, and Flight 158 was ultimately cancelled.
According to T'way Airlines' operational technical disclosure regulations, if the indicator pin length is less than 1 mm, the brakes must be replaced.
That same year, T'way Air held a Central Personnel Committee meeting and concluded that the captain had "unilaterally and unreasonably decided to cancel the flight and neglected his duties as a flight crew member."
The court ruled that the officers were not allowed to carry out their duties in accordance with the principles without fear of reprimand or retaliation, in relation to flight safety, which could pose a serious risk to the lives and bodies of many people.
"The conditions under which the captain can carry out his duties must be guaranteed. We confirm that the disciplinary action taken by T'way Air against the captain is invalid."
"Even if the captain ultimately decides not to operate the aircraft through the operational technical notice,
"It cannot be concluded that he neglected his duties as a flight crew member or exceeded or abused his authority."
