South Korean prosecutors criticize the ruling, saying, ”The second trial only trusted Lee Jae-myung's claims...it doesn't conform to common sense”
On the 26th, the South Korean prosecution announced that it would review the second-instance ruling that found Lee Jae-myung, the head of the main opposition Democratic Party, not guilty of violating the Public Offices Election Act, in order to clarify the facts regarding the main opposition Democratic Party's ruling that was overturned in the first instance.
The Seoul Central District Prosecutors' Office decided to appeal the decision, arguing that the court had simply trusted Jang.
"The ruling is unjust in light of experience and common sense. There is a misunderstanding of the legal principles regarding the crime of publishing false facts under the Public Offices Election Act," he said. "We will appeal and take measures to correct the illegality of the appeal court ruling at the Supreme Court."
The prosecution said, "The appeals court simply believed the defendant's argument, which the first-instance court had rejected after a lengthy trial. At the time,
"They did not take into consideration the suspicion that the defendant had been involved in the rezoning of Baekhyun-dong, which was a matter of national interest, and instead interpreted the defendant's remarks in a completely different way than ordinary voters would interpret them," the lawsuit said.
After more than two years of protracted trial based on numerous testimonies, video calls, photographs, official documents and other evidence, the first-instance court concluded that the general public had interpreted Lee’s remarks as “playing golf with Kim Moon-gi.”
The court also found that there had been no threat from the Ministry of Land, Infrastructure, Transport and Tourism regarding the change in use of the Baekhyun-dong site, but the second trial overturned this.
Lee appeared on the show four times from December 22 to 29, 2021, and said that he did not know of Kim's existence while he was mayor of Seongnam, and did not play golf with Kim during his overseas official business trips.
He also said that he only found out about Kim after he was indicted on charges of violating the Public Offices Election Act after becoming governor, and that the prosecution believed that Lee had made false statements.
In addition, Lee attended the Gyeonggi Province National Assembly Land, Infrastructure, Transport and Tourism Committee's audit of the National Assembly on October 20, 2021, and stated, "Regarding the Baekhyun-dong site, the Ministry of Land, Infrastructure, Transport and Tourism has provided the necessary instructions based on the Innovative City Act.
On the same day, the Seoul High Court Criminal Division 6-2 indicted Lee on charges of publishing false facts under the Election Act.
At the appeal hearing, the court overturned the first-instance verdict of one year in prison with two years' probation and found the defendant not guilty.
